Terms of Service

Welcome to Thinkpilot! These Terms of Service ("Terms") govern your access to and use of the Thinkpilot website (the "Site") and any related services (collectively, the "Services"). By accessing or using Thinkpilot, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
Definitions
"Thinkpilot Ltd." refers to the legal entity registered in Bulgaria, which owns and operates the Thinkpilot platform.
"Thinkpilot Platform" or "Platform" refers to the web-based application, software tools, and associated services provided by Thinkpilot Ltd., including any related websites, APIs, or integrations.
"User" refers to any individual or entity who registers for, accesses, or uses the Thinkpilot Platform, including both account owners and authorized operators or team members.
"User Data" refers to all data, content, files, prompts, responses, or other materials uploaded, entered, generated, or otherwise submitted to the Platform by or on behalf of a User.
"Services" refers to the features, tools, functionalities, and capabilities made available through the Thinkpilot Platform, including but not limited to data analysis, prompt engineering, AI integrations, project management tools, and any updates, enhancements, or new features added by Thinkpilot Ltd.
"Subscription" refers to the time-limited or usage-based access granted to Users upon registration or payment, which may be subject to specific plans, usage limits, and pricing as described on the Thinkpilot Platform or in a separate agreement.
"Account" refers to the unique user profile created by or for a User to access the Platform and Services, which includes login credentials, user settings, access permissions, and usage history.
"Third-Party Services" refers to services, software, data, or APIs provided by third parties and integrated with or accessible via the Thinkpilot Platform. This includes, but is not limited to, services provided by OpenAI, Google, GitHub, or payment processors. Use of Third-Party Services may be subject to additional terms and conditions imposed by those providers.
Acceptance of Terms
By signing up for a Thinkpilot account - whether as the creator of a company account or as an invited team member - you agree to be bound by these Terms and Conditions, including any policies or documents incorporated by reference.
If you are registering or using the Services on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity, and in such case, “you” and “your” will refer to that entity.
If you do not agree to these Terms, you must not access or use the Thinkpilot Platform.
Your continued use of the Services following any update to these Terms constitutes your acceptance of those changes, subject to Section 12 (Changes to Terms).
Eligibility
The Thinkpilot Platform is intended solely for use by businesses and other legal entities. By registering for an account or using the Services, you represent and warrant that you are acting on behalf of a company or other legal entity and that you have the authority to bind such entity to these Terms. If you do not have such authority, or if you do not represent a business, you are not permitted to use the Platform.
You further confirm that you are at least 18 years old and not subject to any legal restriction preventing you from entering into binding contracts.
Access Rights and Restrictions
Subject to these Terms, Thinkpilot Ltd. grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Thinkpilot Platform and Services solely for your internal business purposes.
You may use the Services:
- During a 14-day trial period without payment;
- After the trial, in accordance with an active Subscription Plan.
You are responsible for ensuring that only authorized team members within your organization access the Platform under your business account.
4.1 Prohibited Uses
You agree not to:
- Use the Platform for any unlawful, harmful, or fraudulent activity;
- Copy, reproduce, modify, decompile, reverse engineer, or attempt to extract the source code of the Platform;
- Resell, sublicense, lease, or otherwise transfer your access to the Platform to any third party;
- Upload or distribute any viruses, malicious code, or content that is harmful or violates applicable laws or third-party rights;
- Attempt to circumvent access restrictions, usage limits, or trial mechanisms;
- Interfere with or disrupt the Platform’s security, infrastructure, or functionality.
We reserve the right to suspend or terminate your access if we reasonably believe your use violates these Terms or poses a risk to our systems, other users, or third parties.
4. License and Payments
Thinkpilot is a paid subscription service. Upon creating a business account, you are granted a 14-day free trial to explore the Platform and its features. After the trial period expires, continued access requires a valid Subscription and payment via an accepted payment method.
4.1 Subscription and Billing
- Subscriptions are billed monthly.
- The first payment will be charged on the day your trial expires (if a valid payment method is on file), or immediately upon adding a payment method after the trial has expired.
- Subsequent payments will be charged on the same day each month (or closest equivalent day).
- All payments are processed securely via Stripe.
You authorize Thinkpilot Ltd. and its payment processor to automatically charge your selected payment method in accordance with your subscription plan.
Invoices will be generated and made available to you through your business account, using Stripe's invoicing functionality.
4.2 No Refund Policy
We offer a 14-day free trial so that you can evaluate the Platform before committing to a paid Subscription. Accordingly, all payments are non-refundable, including in cases where a subscription is canceled before the end of the billing period or the account remains unused. This does not override any rights granted to you under applicable law
4.3 Payment Failures and Account Suspension
If a scheduled payment fails, you will be notified and given a 3-day grace period to resolve the issue. If payment is not received within that time, access to your business account and all associated user seats may be suspended until payment is successfully processed.
We reserve the right to terminate access for continued or unresolved payment failures.
5. User Responsibilities
You are responsible for all activity conducted under your business account, including by any team members you invite. You agree to use the Platform in a lawful, professional, and responsible manner.
Specifically, you agree to:
Use the Platform only for purposes permitted by these Terms and applicable laws;
Maintain the confidentiality and security of your account credentials and access tokens;
Notify us immediately at support@thinkpilot.co if you suspect or become aware of any unauthorized access to your business account or misuse of the Platform;
Ensure that your team members understand and comply with these Terms.
Thinkpilot Ltd. will store your data securely and implement appropriate technical and organizational measures to protect its integrity. However, you remain responsible for ensuring that your use of the Platform is compatible with your internal policies and obligations.
Customer support is available via email and will be provided on a reasonable-effort basis during business hours.
6. Data Ownership and Processing
You retain full ownership of all data and content that you or your team members upload to the Platform, including any outputs generated by the Platform in response to your inputs. Thinkpilot Ltd. does not claim any ownership over your business data or generated content.
By using the Platform, you grant Thinkpilot Ltd. a limited, non-exclusive, worldwide license to access, store, process, and use your platform usage data for the purpose of providing and improving the Services. This includes performing usage analytics to better understand user behavior and optimize product functionality.
We do not share your personal data (such as your name or email address) with third parties for advertising or profiling purposes. However, we may use third-party services such as analytics platforms or AI providers to process platform usage data or content strictly for the purpose of operating and improving the Services.
Some limited personal data, such as your name and email address, is collected and processed in accordance with our Privacy Policy, and in compliance with the General Data Protection Regulation (GDPR).
All data is stored securely, and we implement appropriate technical and organizational measures to safeguard its integrity and confidentiality.

7. User Content
You are solely responsible for all content, data, and inputs submitted to the Platform by you or your team members (“User Content”), including any information shared through public links generated on the Platform.
You retain full ownership of all User Content, including both the inputs you provide and the outputs generated in response. Thinkpilot Ltd. does not claim any rights over such content beyond what is necessary to deliver the Services.
You are responsible for ensuring that any content shared publicly via the Platform does not violate any applicable laws, infringe on third-party rights, or contain offensive, harmful, or illegal material. Thinkpilot Ltd. does not actively monitor or moderate User Content, but some of our third-party AI or hosting providers may do so in accordance with their own terms of service.
At this time, we do not access, review, or process User Content for internal purposes, and we do not remove or alter User Content unless required to do so by law or court order.
8. Disclaimers and Limitation of Liability
The Platform and Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied. To the fullest extent permitted by law, Thinkpilot Ltd. disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee that the Services will be uninterrupted, error-free, secure, or free from harmful components, nor do we guarantee the accuracy of any content generated by third-party AI providers used within the Platform.
To the fullest extent permitted by law, Thinkpilot Ltd. shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to lost profits, loss of data, business interruption, or reputational harm, arising out of or related to your use of the Platform, even if we have been advised of the possibility of such damages.
In no event shall Thinkpilot Ltd.'s total liability arising out of or in connection with these Terms exceed the total fees paid by you to Thinkpilot Ltd. in the twelve (12) months preceding the claim.
Nothing in this section limits or excludes liability for gross negligence, fraud, willful misconduct, or any liability that cannot be excluded under applicable law.
9. Termination
9.1 By Thinkpilot Ltd.
We reserve the right to suspend or terminate your access to the Platform and Services immediately, without notice, if:
You or your team members materially breach these Terms;
You use the Platform in a way that causes harm, disruption, or violates applicable laws;
Your subscription payment fails and remains unresolved after a grace period
While we may suspend access for unresolved payments, actual account termination - including deletion of business data - will occur only upon explicit request from the account owner or after a prolonged period of inactivity, at our discretion.
9.2 By the User
You may cancel your subscription at any time through your business account settings. This will stop future billing but will not automatically delete your account or associated data.
If you wish to permanently terminate your account and delete all associated data, you must contact us directly at support@thinkpilot.co . Upon receiving a verified termination request from the account owner, we will permanently delete your business account and all related data, unless we are legally required to retain certain information.
Data deletion will be carried out in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR). You may be asked to verify your identity or authority before we proceed with account termination.
Termination of your account does not entitle you to a refund of any prepaid fees, except as required by law.
9.3 Effects of Termination
Upon termination, your right to access and use the Platform will immediately cease. Any surviving rights or obligations, including those related to ownership, data protection, payment obligations, limitations of liability, and dispute resolution, shall remain in effect.
10. Governing Law & Jurisdiction
These Terms are governed by the laws of the Republic of Bulgaria.
Any disputes related to these Terms, the Platform, or the Services shall be resolved by the competent courts in the Republic of Bulgaria.
11. Feedback
We welcome your feedback, ideas, suggestions, and feature requests to help improve Thinkpilot.
By submitting any feedback to us, you grant Thinkpilot Ltd. a non-exclusive, royalty-free, worldwide, and perpetual right to use, modify, and incorporate that feedback into the Platform or Services. While we are not obligated to offer compensation, your input helps shape the product and benefits all users - including you.
12. Changes of Terms
We may update these Terms from time to time, for example to reflect changes to our services, legal requirements, or business practices.
Whenever we make material changes, we will notify you by email and update the Terms on our website. We will provide reasonable notice before the new Terms take effect.
Your continued use of the Platform after the changes come into effect constitutes your acceptance of the updated Terms.
13. Miscellaneous
These Terms constitute the entire agreement between you and Thinkpilot Ltd. and supersede any prior communications or agreements regarding the Platform or Services.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms freely in connection with a merger, acquisition, or sale of assets.
If we do not enforce a particular right or provision under these Terms, it does not mean we are waiving that right.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Use of the Platform is also governed by our Privacy Policy, which is incorporated by reference.
